Cannabis Testing Lab Plans to Come Before Planning Commission

The Planning Commission on Wednesday will consider a Conditional Use Permit for a 17,399 square-foot cannabis-testing laboratory within an existing commercial office building on Bellevue Drive.

“Encore Labs submitted an application to operate a cannabis-testing laboratory within a 17,399 square-foot, three-story, commercial office building located at the subject site,” according to a City staff report. 

Encore Labs is proposing to utilize the majority of the first floor as dedicated laboratory space. Administrative offices for sales, marketing, finance and administrative staff, as well as storage space, would be located within the second and third floors. 

The proposed hours of operation would be from 8:00 a.m. to 8:00 p.m. Monday through Sunday.

The second office building on the site will continue to be used as a one-story administrative office building by other tenants. The property contains thirty parking spaces that will be shared by the tenants on the site.

According to the staff report, Encore Labs is an existing non-conforming cannabis-testing laboratory currently operating at 75 N. Vinedo Ave. 

The lab was established in 2017 prior to current requirements which call for a Conditional Use Permit. 

They are the only cannabis-testing laboratory in the city. 

Encore Labs has outgrown its current 6,000 square-foot laboratory facility and are proposing to relocate their operations to 120 W. Bellevue Drive.

City documents show Encore Labs has operated their existing laboratory with no Code Compliance violations nor complaints and has maintained their state license in good standing.

“Although Encore Labs’ current laboratory at 75 N. Vinedo Avenue is legal non-conforming, a move to a different location requires compliance with all current cannabis regulations,” according to a City staff report. 

Regulations for cannabis-testing laboratories include compliance with Title 5, business license, taxation, annual cannabis permit, security plan, operating standards, fingerprinting and community benefits plan, etc. The lab must also comply with Title 8, health permit and health-related regulations, and Title 17, zoning regulations and operating conditions.
