City Settles With Jerry’s Billiards

According to a staff report, the City has reached a settlement with a local billiards hall regarding hours of operation, and safety and noise abatement.

The City Council approved the settlement last week in closed session.

The lawsuit arose over the billiard hall’s nonconforming status. Per the settlement, Jerry’s Billiards would be open from 11 to 12:15 a.m. and until 1 a.m. on the weekend.

Management will be required to post policy on the backdoor prohibiting customers from loitering, causing disturbances or making loud noises in the parking lot after 10 p.m.

Management is also required to keep the back door locked and not allow customers to congregate after 10 p.m.

The City Council unanimously upheld the earlier Board of Zoning Appeals’ decision to limit the hours of operation of a long-time local billiards hall, requiring it to close at 10 p.m. instead of its current 1 a.m. 

In September 2022, the City’s Zoning Administrator determined that Crown City Billiards & Lounge, formerly and popularly known as Jerry’s Family Billiards, should operate between 7 a.m. to 10:00 p.m. as required by the Zoning Code Section 17.40.070 which states that commercial uses on a site located within 150 feet of a residential zoning district may only operate between the hours of 7:00 a.m. and 10:00 p.m.

The Zoning Administrator’s determination was initiated after the City’s Code Compliance Division issuance of a citation in April 2022, indicating that the business was operating beyond 10 p.m., in violation of the Zoning Code. 

A Conditional Use Permit, known as a CUP, is needed in order for the establishment to operate beyond 10 p.m.

Crown City Billiards & Lounge challenged the determination and argued that their business is a nonconforming business and is not subject to Section 17.40.070. However, the Zoning Appeals Board upheld the Zoning Administrator’s determination last January. 

During previous hearings on the matter, residents raised concerns about noise and loitering particularly at the parking lot near the establishment.

During the eight months prior to the citation, when the establishment was open past 10:00 p.m., 17 calls for police service were made between the hours of 10:00 p.m. and 3:00 a.m. Seven calls for service were made for the eight months after the citation, during the same hours. 

Located at 1312 N. Lake Ave. Crown City Billiards & Lounge has been operating since January 1985.
